Child Custody
Under Idaho state law, if both parties fail to agree on how to share custody and parenting time, a judge will make the decision and award legal and physical custody to one or both parents. In order to file for divorce in Idaho, you must have lived within state lines for at least six weeks. Since Idaho adheres to the “no-fault” divorce system, the reason(s) as to why the marriage failed need not be explained upon filing for divorce. Simply stating that the marriage suffers from “irreconcilable differences” will suffice.
To file for divorce (without children) in Idaho, you must submit a family law case information sheet, complaint for divorce, summons with orders, affidavit of service with orders, and a vital statistics certificate of divorce.
